Issue 1: Where are the suspect?

But the LORD God called to the man, "Where are you?" He (Adam) answered, "I heard you in the garden, and I was afraid because I was naked; so I hid."
Hypothesis:
Adam was afraid. Two assumptions can be made. First, knowledge was revealed to him when he ate the fruit from the tree of knowledge of good and evil, he's afraid of his nakedness. Second, he knew that he had disobeyed God.
Issue 2: Crime committed?

When the woman (Eve) saw that the fruit of the tree (the tree of the knowledge of good and evil) was good for food and pleasing to the eye, and also desirable for gaining wisdom, she took some and ate it. She also gave some to her husband (Adam), who was with her, and he ate it.
Hypothesis:
Eve took the fruit from the tree of the knowledge of good and evil and ate it. And she gave it to Adam and Adam ate it as well.
Motive:
Desire to gain wisdom (Gen. 3:6),
To be like God (Gen. 3:4)
Charged under law: [Genesis 2:16-17]
And the LORD God commanded the man, "You are free to eat from any tree in the garden; but you must not eat from the tree of the knowledge of good and evil, for when you eat of it you will surely die."
Penalty: Death
Issue 3: The mastermind?

Now the serpent was more crafty than any of the wild animals the LORD God had made. He said to the woman, "Did God really say, 'You must not eat from any tree in the garden'?"
The woman said to the serpent, "We may eat fruit from the trees in the garden, but God did say, 'You must not eat fruit from the tree that is in the middle of the garden, and you must not touch it, or you will die.' "
"You will not surely die," the serpent said to the woman. "For God knows that when you eat of it your eyes will be opened, and you will be like God, knowing good and evil."
Hypothesis:The serpent cast doubts upon the woman by asking questions about God's commandment. Due to the lack of knowledge of God's word, the woman was led into disobeying God and ate from the tree of knowledge of good and evil. The serpent twisted the word of God and misled Eve.
Proofs of criminal actions:
- Knowledge of nakedness
- Hiding from God
The interrogation: [Genesis 3:11-13]
And he said, "Who told you that you were naked? Have you eaten from the tree that I commanded you not to eat from?"
The man said, "The woman you put here with me—she gave me some fruit from the tree, and I ate it."
Then the LORD God said to the woman, "What is this you have done?"
The woman said, "The serpent deceived me, and I ate."
God demanded confession. but Adam did not admit in his reply. And by saying "The woman you put here with me", Adam blames God instead when God was totally not involved in this act of crime. On the other hand, Eve confessed immediately by saying "I ate." and pointed out the mastermind "The serpent deceived me."
Conclusion:
Adam and Eve was found guilty of eating from the tree of knowledge of good and evil. Eve chose to believe in the serpent's lies and twisted words and first commit the sin. She led Adam into eating the fruit of tree of knowledge of good and evil. However, the sin of Adam was greater because he did not confess his sin and that he did not tell the word of God properly to Eve. The serpent was found guilty for deceiving Adam and Eve.
Penalty: [Genesis 3:14-19]
So the LORD God said to the serpent, "Because you have done this,
"Cursed are you above all the livestock
and all the wild animals!
You will crawl on your belly
and you will eat dust
all the days of your life.
And I will put enmity
between you and the woman,
and between your offspring and hers;
he will crush your head,
and you will strike his heel."
To the woman he said,
"I will greatly increase your pains in childbearing;
with pain you will give birth to children.
Your desire will be for your husband,
and he will rule over you."
To Adam he said, "Because you listened to your wife and ate from the tree about which I commanded you, 'You must not eat of it,'
"Cursed is the ground because of you;
through painful toil you will eat of it
all the days of your life.
It will produce thorns and thistles for you,
and you will eat the plants of the field.
By the sweat of your brow
you will eat your food
until you return to the ground,
since from it you were taken;
for dust you are
and to dust you will return."
